Throughout these Terms of Service, “Filupen”, “we”, “us” and “our” refer to the person or business identified above.

About these terms

These Terms of Service apply when you visit our website or purchase products from us. By placing an order, you agree to these terms.

Please read these terms before placing an order. If you do not agree with them, you should not place an order.

You must be at least 18 years old and legally capable of entering into a contract to place an order.

Products

We take reasonable care to ensure that product descriptions, photographs, prices and other information are accurate. However, colours and appearance may vary slightly depending on your device and screen settings. Product images are provided for illustrative purposes, and packaging may vary.

We may update product information, limit the quantities available or discontinue a product. These changes will not affect orders that we have already accepted.

Age and adult supervision

The 3D pen heats filament during normal use and must be used in accordance with the safety instructions supplied with the product.

Children should use the product only if they meet the age guidance shown on the product packaging and instructions. Appropriate adult supervision is required, particularly during initial use.

The heated tip and surrounding components may become hot. They should not be touched during use or before the product has cooled completely.

The product and its accessories must be kept away from children below the minimum age stated on the packaging. Small components may present a choking hazard.

Parents and guardians are responsible for ensuring that the product is used safely, appropriately and in accordance with its instructions. Nothing in this section limits our responsibility for supplying a safe and legally compliant product.

Prices and payment

All prices are displayed in pounds sterling (GBP) and include any taxes that are applicable to the purchase.

Delivery charges are displayed separately during checkout before you place your order.

We may change our prices at any time, but changes will not affect orders that we have already accepted.

If we discover an obvious pricing error after you place an order, we will contact you. You may confirm the order at the correct price or cancel it for a full refund. We will not process the order at an incorrect price where the error was obvious and could reasonably have been recognised as an error.

Payment is taken when you place your order. We accept the payment methods displayed at checkout.

Placing an order

Your order constitutes an offer to purchase products from us.

After receiving your order, we will send you an order acknowledgement. This acknowledgement confirms that we have received your order but does not mean that we have accepted it.

A contract is formed when we send you an email confirming that your order has been dispatched. If we cannot accept or fulfil your order, we will notify you and refund any payment received.

Please check your order information carefully before submitting it. You are responsible for providing accurate billing, delivery and contact information.

Delivery

Available delivery options, estimated delivery times and applicable charges are displayed during checkout.

We will deliver your order to the address provided during checkout. You are responsible for ensuring that the delivery address is complete and accurate.

Delivery dates are estimates unless we expressly agree to a specific date. We are not responsible for delays caused by events outside our reasonable control, but we will contact you if a significant delay occurs and explain the available options.

Unless we agree otherwise, goods will be delivered without undue delay and no later than 30 days after the contract is formed.

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to receive them.

Cancellation, returns and refunds

Your rights to cancel an order, return products and receive a refund are explained in our Returns & Refunds Policy, which forms part of these terms.

Nothing in these terms or our Returns & Refunds Policy limits your statutory consumer rights.

Faulty goods

We are legally responsible for supplying goods that are as described, fit for purpose and of satisfactory quality.

If a product is faulty, damaged or not as described, contact us at support@filupen.com with your order number and details of the problem.

Your rights regarding faulty goods are explained further in our Returns & Refunds Policy and under the Consumer Rights Act 2015.

One-year commercial warranty

In addition to your statutory rights, we provide a one-year commercial warranty on the pen beginning on the date it is delivered.

If the pen stops working because of a manufacturing defect during this period, email support@filupen.com with your order number and a description, photograph or short video of the problem. Depending on the circumstances, we will repair or replace the pen or provide an appropriate refund.

This warranty does not cover accidental damage, misuse, water damage, unauthorised modification or normal wear and tear. Consumable materials, including used filament, are not covered unless they were faulty when supplied.

This commercial warranty is provided in addition to your statutory rights. Your statutory rights may continue after the warranty has expired.

Acceptable use of our website

You must not misuse our website, interfere with its operation, attempt to gain unauthorised access to it or use it for unlawful or fraudulent purposes.

The content of this website, including its text, photographs, graphics, logos and designs, belongs to us or is used with permission. You may use the website for personal and non-commercial purposes. You must not copy, reproduce, distribute or commercially exploit its content without permission, except where permitted by law.

Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot legally be excluded, or a breach of your statutory consumer rights.

If we fail to comply with these terms, we are responsible for loss or damage that is a foreseeable result of that failure or of our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

We supply products for private and domestic use. If you use a product for a commercial or business purpose, we are not responsible for loss of profit, loss of business, business interruption or loss of business opportunity, except where such liability cannot legally be excluded.

Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control.

If such an event significantly affects our ability to fulfil your order, we will contact you as soon as reasonably possible. Where appropriate, you may cancel the affected order and receive a refund for products that have not been supplied.

Governing law and disputes

These terms are governed by the laws of England and Wales.

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may bring proceedings in the Scottish courts. If you live in Northern Ireland, you may bring proceedings in the courts of Northern Ireland.

If you live outside the United Kingdom, you may also benefit from mandatory consumer protections available under the laws of your country of residence. Nothing in these terms limits those mandatory rights.

Changes to these terms

We may update these Terms of Service occasionally to reflect changes to our business, products or legal obligations.

The version in force when you place your order will apply to that order. Changes made after we accept an order will not alter the terms of the existing contract unless required by law or agreed with you.
